Terms and Conditions

These General Terms and Conditions (“Terms”) govern the access to and use of all services and products offered by Pineapple Car Service LLC (“Company,” “we,” “us,” or “our”) through its websites (pineapple.site and aboutcar.site) and the “Portals” mobile application. By using our service, you agree to comply with all included provisions as well as referenced policies such as our Privacy Policy and Terms of Sale. Use of the website or services implies acceptance of electronic communication for transactional and legal purposes.

1. PRICING AND ORDER TERMS

1.1 Pricing and Vehicle Categories

Prices for all products and services are subject to change. For car wash services, we operate on a flat-rate pricing model based on three categories:

  • Category A: Sedan / 5-Seat SUV

  • Category B: 5+ Seat SUV / Truck

  • Category C:  Customized Quotation

1.2 Inspection and Tax

The final price for services may vary based on a detailed inspection of the vehicle’s condition. Any changes in price will be communicated to the customer for approval before being applied. Listed prices do not include tax; the final total will include all applicable taxes.

1.3 Payment and Refund Terms

  • Payment Failure: If a payment method fails, customers must promptly arrange an alternative. We may initiate a collection process if no resolution is received within 24 hours.

  • Refunds: Gift card and store credit purchases are final and non-refundable. For services rendered, we reserve the right to decline refund requests following completion and inspection.

  • Credit Card Dispute Resolution: We encourage open communication. Please reach out to our team at service@pineapple.site before initiating a chargeback. The Company reserves the right to deny future service in cases of malicious or repeated unfounded disputes.

2. ABOUT CAR TERMS (aboutcar.site)

2.1 Product Availability and Delivery

All orders are subject to stock availability. We may offer substitute products of equal or higher value if an item is unavailable; if declined, a full refund will be issued.

  • Delivery Area: Delivery is limited to the contiguous United States. We do not ship to Alaska, Hawaii, APO addresses, or U.S. territories.

  • Ownership and Risk: Ownership of products transfers to the customer upon full payment and delivery. Responsibility for product condition also transfers at the time of delivery. If a package cannot be delivered, it may be left in a secure location or returned to our depot; additional storage or redelivery fees may apply.

2.2 Returns and Defective Products

Unopened products in original packaging may be returned within 14 calendar days of Shipment Confirmation. If you believe a product is defective, contact us via our Contact Us page. Confirmed defects are eligible for refund or replacement within 30 days, excluding shipping costs.

3. PINEAPPLE CAR WASH TERMS (pineapple.site)

3.1 Coverage Area and Logistics

Services cover areas within a 25-mile radius of our address in Sunnyvale, CA (94086). Additional travel fees apply beyond this range.

  • Arrival: Detailers have a 15-minute grace period. If more than 30 minutes late without notice, you may cancel at no cost.

  • Rain Policy: We check forecasts in advance; however, rain checks are not offered due to natural elements. Rescheduling or cancellation due to weather follows the policies in Section 3.2.

3.2 Cancellation and No-Show Policy

  • Rescheduling: Free if requested before the service day. Same-day changes (before the crew is en route) incur a 20% fee of the service price.

  • Cancellation: Free if ≥24 hours in advance. If <24 hours, PCW Members are free, while non-members incur a 50% fee.

  • No-Show (The 15-Minute Rule): On appointment day, if there’s no response or the car is not present within 15 minutes of our arrival, a 45% fee of the service price will apply to cover labor, travel, and committed time.

4. LIABILITY, PROPERTY, AND SAFE ENVIRONMENT

4.1 Independent Contractor Disclosure

The Company operates through a network of vetted independent contractors. Pineapple Car Service LLC is not responsible for loss, damage, or theft of personal property unless otherwise specified by law. Each contractor is independently responsible for legal compliance and any injuries or damages resulting from their services.

4.2 Pre-existing Conditions

The Company and its contractors are not liable for damages resulting from a vehicle’s pre-existing conditions.Detailing procedures may expose or worsen these conditions. Exclusions include, but are not limited to:

  • Paint: Oxidized paint, faded/flaking paint, peeling clear coat, or fragile/aftermarket paintwork.

  • Repairs: Evidence of previous body work, paint repairs, or touch-ups.

  • Wear: Aged or deteriorating trim, molding, decals, vinyl wraps, or seals.

4.3 Specialized Vehicles

Customer acknowledges that the Company is not liable for any damages or incidents occurring during detailing services on RVs, jet skis, or motorcycles.

4.4 Photo Authorization

The customer consents to the Company taking photos of the vehicle before, during, and after service for inspection, quality control, and promotional/advertising use.

4.5 Safe Working Environment

The Company reserves the right to refuse or terminate service immediately if a service location is deemed unsafe (e.g., aggressive animals, hazardous materials, or harassment). In such cases, a 45% mobilization fee may apply.

5. INTELLECTUAL PROPERTY AND USER CONDUCT

5.1 Intellectual Property

The domains pineapple.site and aboutcar.site, and the names "Pineapple Car Service," "Pineapple Car Wash," and "About Car" are trademarks of Pineapple Car Service LLC. All content, including graphics, logos, technology (designs, software, scripts), and written material, is protected by intellectual property laws. Unauthorized use, reproduction, or modification is strictly prohibited.

5.2 User Conduct

Users must be at least 13 years old. You agree not to: access the platform via third-party accounts without consent, copy content without authorization, upload viruses, or attempt to compromise our network security.

5.3 DMCA Copyright Policy

If you believe any content on our Platform infringes your copyright, please send a notice of infringement to our Copyright Agent at service@pineapple.site containing the information required by 17 U.S.C. § 512.

6. DATA PRIVACY AND COMMUNICATION

6.1 Confidentiality

We are committed to maintaining strict confidentiality and will not share personal information with third parties (except PCS sub-brands) unless authorized or required by law.

6.2 SMS/MMS Mobile Messaging

By providing your phone number, you consent to receive SMS communications regarding service updates, promotions, and support. Message/data rates apply. Reply STOP to opt out at any time.

7. LEGAL FRAMEWORK AND GENERAL PROVISIONS

  • Jurisdiction: These Terms are governed by California law. You agree to the exclusive jurisdiction of the state or federal courts in Santa Clara County, CA, and waive the right to a jury trial.

  • Amendments: The Company may revise these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.

  • Severability: If any provision is invalid, the remainder remains in full effect.

  • Force Majeure: Neither party is liable for delays due to causes beyond their control (e.g., natural disasters or governmental actions).

  • Termination: The Company may modify or discontinue access to services at its sole discretion without prior notice.

  • Indemnification: You agree to indemnify the Company from any third-party claims arising out of your use of the platform or violation of these Terms.

8. CUSTOMER AGREEMENT (CHECKBOX CONSENT)

By checking the "I agree to the Terms and Conditions" box at checkout or via our contact forms, you acknowledge and agree that:

  1. Consultation: You have communicated with a Pineapple Car Wash specialist and understand the services selected.

  2. Authorization: You authorize the services and accept responsibility for the total cost, including applicable taxes, upon completion.

  3. Electronic Signature: Checking the box constitutes a legal electronic signature with the same force and effect as a handwritten signature.
